These Terms of Service (TOS) govern the use of the services provided by Koya, including its website https://koya.gg and its application on the Discord platform (Discord Inc.).

These TOS constitute the agreement between the services offered, hereinafter referred to as "Koya", the Publisher of the service, and the User, who accesses the services via the website or Discord application. Accessing the services implies full and unconditional acceptance of these TOS.

Article 1: Purpose

These TOS define the conditions under which Users may access and use the services offered by Koya. These services include various features for managing Discord servers and their members, accessible via the Discord application and the website.

Article 2: Service Description

Koya's services allow users to access additional features facilitating the management of their Discord servers and communities. These features are configurable via the application or the website.

Article 3: Legal Information

In accordance with Article 6-III of French Law No. 2004-575 of June 21, 2004, the publisher is not required to disclose personal information in the legal notice.

Article 4: Service Access

Access to Koya's services is provided through the website https://koya.gg and the application available on Discord. Users must log in with their Discord account to use the application and access its features.

The website offers several services including application settings management, user documentation, and a support space to help users resolve issues. The support space is accessible via the dedicated Discord server: https://discord.gg/koya.

Premium subscriptions can be managed at koya.gg/subscriptions.

In the event of maintenance or technical issues, access to services may be temporarily suspended. Koya will notify users of interruptions via its support server.

Article 5: Data Collection

The Koya application collects personal data such as the username, profile picture, and email address. This data is necessary for the proper functioning of the services offered and for payment processing.

Koya accesses User data provided by Discord, including:

  • The username and avatar
  • The user's email address
  • Basic information about associated Discord servers

Additionally, during checkout, your IP address and user-agent are collected for fraud prevention and security purposes.

Article 6: Intellectual Property

All content of the Koya application, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is protected by copyright. Any unauthorized reproduction or use is strictly prohibited without the express prior consent of the publisher.

The use of content for commercial, advertising, or profit-making purposes is prohibited without the publisher's authorization.

Article 7: Liability

Koya cannot be held responsible for damages resulting from incorrect use of the services or misconfiguration of Discord servers. Users agree to report any vulnerability without attempting to exploit it.

Koya does not guarantee absolute data security, although it commits to taking all necessary measures to ensure data confidentiality and security.

Article 8: Disputes and Chargebacks

In the event of any billing dispute or service concern, Users must contact our support team at [email protected] or via our Discord server before initiating a payment dispute or chargeback.

Premium services are digital services delivered immediately. Fraudulent chargebacks filed for successfully delivered digital services may result in immediate account termination and a permanent ban from all Koya services.

Article 9: Applicable Law

These TOS are governed by French law. In the event of a dispute that cannot be resolved amicably, French courts shall have jurisdiction.
